These terms govern your use of this website and any services provided by Kayser Marketing (“we”, “us”, “our”). By engaging our services or using this site, you agree to these terms. If you have questions before signing on, just ask.
Kayser Marketing provides digital marketing services including SEO, Google Ads management, Meta Ads management, content marketing, web design, ghostwriting, and custom app development. The specific scope of services, deliverables, and timelines are agreed upon in writing before work begins — either through a signed proposal, statement of work, or email confirmation.
Project-based work (web design, custom app development, one-off campaigns) requires a 50% deposit before work begins, with the remaining balance due upon project completion. Monthly retainer services are billed at the start of each billing period. Invoices are payable within 14 days. Work may be paused on accounts with outstanding invoices beyond 30 days.
Upon receipt of full payment, all deliverables created for you — including website files, ad copy, content, and design assets — become your property. Kayser Marketing retains the right to reference completed work in portfolios, case studies, and marketing materials unless you request otherwise in writing.
Digital marketing involves inherent uncertainty. We commit to applying proven strategies, transparent reporting, and continuous optimization — but we cannot guarantee specific rankings, traffic levels, conversion rates, or revenue outcomes. Past client results (such as those referenced on this website) reflect individual campaigns and are not a promise of future performance.
Monthly retainer services can be cancelled with 30 days written notice. No refunds are issued for the current billing period on retainer services. For project-based work, the deposit is non-refundable once strategy and planning work has begun. If Kayser Marketing cancels a project for any reason, a prorated refund of the deposit will be issued for work not yet completed.
You agree to provide timely feedback, access to relevant accounts (Google Ads, Meta Business Manager, website CMS, etc.), and accurate information about your business. Delays caused by late approvals, missing access, or withheld information are not the responsibility of Kayser Marketing and may affect agreed timelines.
Both parties agree to keep confidential any sensitive business information shared during the engagement — including pricing, strategy, client data, and unreleased products or campaigns. This obligation survives the end of the engagement.
To the maximum extent permitted by applicable law, Kayser Marketing's liability for any claim arising from services provided is limited to the total fees paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits, lost data, or business interruption.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Peterborough, Ontario.
We may update these terms from time to time. Updated terms will be posted on this page with a revised "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the updated terms. For active engagements, material changes will be communicated directly.
